These Terms and Conditions ("Terms") govern your access to and use of websites, products, and services operated by PennWelding™ Corporation, including but not limited to PennWelding.com, WeldTestByMail.com, WeldingCerts.com, and any affiliated domains (collectively, the "Company," "we," "us," or "our"). By accessing our websites or purchasing any products or services, you agree to be bound by these Terms.
1. SCOPE OF SERVICES
The Company provides physical welding test materials, welding-related products, and professional weld testing and evaluation services, including mail-in welder qualification testing conducted in accordance with AWS D1.1 and related standards. Services may include the issuance of Welding Procedure Specifications (WPS), testing authorization, inspection coordination with Certified Welding Inspectors (CWIs), and issuance of welder qualification documentation upon successful completion of testing.
2. NO GUARANTEE OF PASSING
Purchase of any weld test plate, testing service, mail-in testing package, or related product does NOT guarantee that a welder will pass a test.
Weld test outcomes are dependent on factors outside the Company's control, including but not limited to:
- Welder skill and technique
- Adherence to the WPS
- Welding equipment and consumables
- Environmental conditions
- Test execution
The Company does not provide welding instruction, coaching, or corrective services. The Company's role is limited to evaluation and documentation of submitted weld test coupons in accordance with applicable standards.
3. WELDER QUALIFICATION VS. CERTIFICATION
Under AWS standards, welders are "qualified," not "certified." Qualification is performed on behalf of an employer. The Company evaluates weld test coupons and documents results; the welder's employer is solely responsible for verifying the identity of the welder and accepting the qualification for official use.
4. APPROVED MATERIALS REQUIREMENT
All weld test coupons submitted for evaluation must be supplied by the Company or its authorized divisions. Test plates fabricated, sourced, or modified outside of the Company will not be accepted for testing. Plates are identifiable by Company markings and other verification methods.
5. TESTING AUTHORIZATION
Mail-in weld testing packages include one (1) testing authorization. Authorization may only be used with Company-supplied test plates. Authorization remains valid if a test plate is damaged, scrapped, or not submitted, provided a replacement plate is purchased from the Company.
6. INTELLECTUAL PROPERTY
All Welding Procedure Specifications (WPS), documentation, test forms, written materials, website content, graphics, and instructional materials are proprietary intellectual property of the Company or its licensors. Upon issuance, WPS documents are deemed delivered and are non-refundable. Unauthorized reproduction or redistribution is prohibited.
7. SHIPPING POLICY
Outbound shipping costs are the responsibility of the customer unless otherwise stated. Shipping costs are non-refundable. Customers are responsible for return shipping on all returns. The Company is not responsible for delays caused by carriers. Claims for lost or damaged shipments must be reported within five (5) business days of delivery.
8. RETURNS AND REFUNDS
Unused, unmodified physical test plates may be returned subject to Company approval and issuance of a Return Merchandise Authorization (RMA). Professional services, documentation, WPS issuance, testing authorization, inspection services, and administrative fees are non-refundable once issued.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of its products or services. The Company's total liability shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
10. ASSUMPTION OF RISK
Welding involves inherent risks. Customers assume all risks associated with welding activities, use of test plates, and performance of weld tests. The Company disclaims all responsibility for injuries, damages, or losses arising from welding activities.
11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
12. MODIFICATIONS
The Company reserves the right to modify these Terms at any time. Continued use of the websites or services constitutes acceptance of updated Terms.
